Come sempre buongiorno popolo di italy, dopo i miei ultimi post sul tema, ho pensato di scriverne un terzo per cercare di raccontare cosa stia effettivamente accadendo in modo semplice e accessibile a tutti.

Premessa fondamentale: è un provvedimento di urgenza.

Perchè questa premessa è importantissima?
In questa intervista fatta da Matteo Flora (link) a Guido Scorza, uno dei componenti del Garante per la protezione dei dati personali, al minuto 13:10, dopo un'opposizione dello stesso Matteo sul fatto che alcune cose contestate ad OpenAI siano sbagliate, Guido specifica:
"E' un provvedimento di urgenza, e come tutti i provvedimenti di urgenza, non sempre è super raffinato nel linguaggio [...]"
Questo provvedimento ha aperto un'istruttoria che poi con tutte le sue tempistiche e procedure metterà bene i puntini sulle i.
Vorrei quindi concentrarmi sulla sostanza di quello che il garante sta contestando ad OpenAI, indipendentemente da cosa c'è scritto in maniera super specifica nel provvedimento.
In tutta la mia trattazione, sarà sempre preferita da parte mia la chiarezza comunicativa, rispetto alla precisione giuridica. Nei commenti poi, chi ha molta padronanza tecnica sulla materia, è assolutamente il benvenuto per aggiungere informazioni e dettagli.

Cosa viene contestato?

Sostanzialmente 3 problemi:

1. Le modalità con cui sono stati raccolti dati per fare il training dell'algoritmo
2. Il fatto che non venga applicato nessun tipo di filtro per accedere il sistema da parte di minori di 13 anni
3. Il fatto che in fase di registrazione non ci sia un consenso esplicito che l'utente fornisce ad OpenAI per il trattamento dei suoi dati

A detto dello stesso Guido, e anche a mio parere, i punti 2 e 3 non sono particolarmente importanti. Nel senso che se anche fosse stata commessa un'infrazione, si può rimediare facilmente con tutte le modifiche del caso.
Il primo problema invece è molto più sostanziale, perchè direttamente connesso all'erogazione del servizio e di un danno arrecato ai cittadini Italiani (e di fatto Europei) ancor prima che venisse lanciato ChatGPT.

Cosa dice il GDPR sul Web Scraping?

Per i non addetti ai lavori, per Web Scraping si intende un insieme di tecniche atte ad estrarre dati da pagine internet per importarle in altri servizi o database.
Un esempio di web scraping, sarebbe creare uno script per raccogliere in un database tutti i thread che vengono scritti su reddit.
In senso generale, il web scraping non è proibito, ma è soggetto a GDPR nel momento in cui io raccolgo anche dati personali degli utenti.
Ad esempio, se io ho un profilo LinkedIn, con indicato il mio nome, cognome ed indirizzo mail, nel momento in cui un ente terzo viene sul mio profilo LinkedIn ed esporta questi dati dalla piattaforma per salvarli in un suo database, sta commettendo un'infrazione ai sensi del GDPR.
L'elemento chiave di lettura è che i miei dati sono SEMPRE miei. Se io mettessi il mio numero di telefono su Instagram in chiaro, nessuno sarebbe comunque autorizzato ad utilizzarlo per chiamarmi senza il mio consenso.
Quello che il garante contesta ad OpenAI, è di non aver avuto nessuna base legale per poter raccogliere anche dati personali di utenti nelle sue attività di web scraping.

Quali "basi legali" sono ammesse per fare Web Scraping di dati personali secondo il GDPR?

L'articolo 6 del GDPR, sostanzialmente identifica 6 casistiche in cui questo si possa fare:
​

1. Consenso: Ovvero quando ho un consenso esplicito dell'utente. Capite bene che questa modalità è pressochè impossibile quando si parla di web scraping. E' come se qualcuno dovesse farvi accettare un modulo di consenso prima di salvarsi da qualche parte quello che legge nel web su di voi. Da un punto di vista pratico è irrealizzabile.
2. Contratto: Ovvero quando c'è un contratto tra me e l'utente interessato e quei dati mi servono per erogare il servizio. Ai fini della nostra trattazione, sostanzialmente questa modalità è molto simile alla prima.
3. Obbligo Legale: Ovvero se per qualsiasi motivo la legge mi obbliga a farlo. Queste sono sempre cose molto specifiche e precise, che raramente possono essere utilizzate come argomentazioni per legettimare le proprie attività.
4. Interesse Vitale: Quando l'attività di raccolta dati è fatta per preservare un interesse vitale di quella persona. Per intederci in modo semplice, se arrivate in fin di vita al pronto soccorso, anche senza il vostro consenso, l'ospedale può andarsi a recuperare ogni dato che trova per cercare di salvarvi la vita.
5. Obbligo Pubblico: Tendenzialmente questo si applica ad un pubblico ufficiale, che è autorizzato a raccogliere i dati che gli servono per svolgere i suoi compiti. Un po' come la guardia di finanza che non ha bisogno del vostro consenso.
6. Interesse Legittimo: Il supercazzolone! Questo punto è estremamente vago ed è quello che può essere argomentato dalle aziende sul perchè hanno fatto quello che hanno fatto. Ovviamente una motivazione del tipo "volevo fare un pacco di soldi" non sarà mai accettata. Ma tendenzialmente questo punto è quello sul quale si ha la possibilità di discutere con il Garante ed in generale con l'Europa.

Di conseguenza, OpenAI è obbligata a chiedere il consenso agli utenti per fare scraping anche di dati personali? Ni.
Se avesse avuto il consenso, non ci sarebbero stati problemi. Ma questo è proprio non possibile quando si parla di web scraping.
Tuttavia, se è capace di dimostrare e argomentare un Interesse Legittimo sul perchè ha fatto quello che ha fatto, si può arrivare ad un accordo.
Nota Bene: Su certe tematiche, i motori di ricerca godono di particolari esenzioni decise a livello comunitario. Attualmente l'Europa sta studiando un AI Act ed è ben possibile che in questo AI Act vengano definite delle regole particolari per il training di algoritmi.
In generale, quello che manca ora da parte di OpenAI, è una totale trasparenza su come abbia operato. Non si sa bene cosa ha raccolto e come. Se i dati ad esempio fossero stati anonimizzati prima di usarli per il training dell'algoritmo, non ci sarebbero più problematiche. Ma ad oggi OpenAI opera con modalità non chiare.
Attenzione: su tematiche di AI, operare in modo non chiaro, può anche essere qualcosa di desiderato dalla società. Sappiamo tutti che GPT4 è capace di molte cose, alcune anche terribili nel momento in cui si riesce a fare un jail break, ad esempio spiegare come costruire bombe o molto peggio. Quindi non è così scontato che la trasparenza verso il pubblico generale sia una cosa positiva, se questa consentirebbe di rompere il modello. E' possibile che nell'AI Act venga anche designato un nuovo organo di vigilinza che certifichi alcuni processi di chi fa training di modelli, senza che queste procedure siano conosciute al pubblico generale.

Perchè agire proprio ora e non aspettare l'AI Act?

Queste ovviamente possono essere solo speculazioni da parte mia, però pochi giorni fa, c'è stato un brutto data breach che ha consentito a diversi utenti di leggersi le conversazioni di altri utenti all'interno della piattaforma.
Il Garante della privacy non ha direttamente contestato questa cosa, anche se il data breach va segnalato e gestito in un modo particolare.
Tuttavia credo sia molto ragionevole supporre che queso fatto abbia portato OpenAI sotto la lente d'ingradimento.
Questo spiegherebbe anche il perchè di un provvedimento di urgenza.
"Ma perchè sempre noi Italiani dobbiamo essere nel medioevo?"
Premetto che io non sono d'accordo con le modalità con la quale è stato fatto questo provvedimento. Sarebbe bastato chiedere delucidazioni senza imporre un blocco al trattamento dei dati (dopo vediamo che significa).
Tuttavia, onestamente poco importa che prima sia partita l'Italia o qualche altro Paese Europeo. Questa tematica riguarda tutta l'Europa, e anche altri enti preposti, come quello Irlandese, ci stavano buttando l'occhio.
Poi purtroppo questa notizia si aggiunge a quella sulle carni sintetiche recenti e sinceramente non ci fa sembrare un Paese particolarmente aperto all'innovazione ^{(e secondo me prima o poi dovremmo anche fare un bel post qua dove si parla di OGM visto il problema idrico, così come del fatto che "obblighiamo" paesi Africani a fare coltivazioni Non-OGM in un contesto climatico impossibile per loro, perchè altrimenti non possono esportare da noi e non ci mangiamo la loro roba. Ma queste sono altre tematiche. BTW il modo in cui abbiamo inventato il Pomodoro Pachino IGP è veramente borderline con il concetto di OGM, quindi siamo anche ipocriti})

FAQ: la domanda che tutti aspettano, il Garante ha bloccato ChatGPT o si sono oscurati loro?

Il garante ha disposto un blocco immediato al trattamento dei dati.
Questo non significa esplicitamente bloccare il servizio, però è come se il garante ti dicesse: "Se tu riesci ad erogare il servizio senza trattare dati personali, per me puoi pure continuare mentre facciamo l'istruttoria, altrimenti ti devi fermare".
OpenAI ha scelto di oscurarsi nei confronti degli utenti italiani. Questa cosa può avere 2 letture diverse:
​

1. O effettivamente non hanno modo di bloccare solo il trattamento dei dati, senza buttare giù tutto. E quindi è quasi una sorta di "ammissione di colpa".

Tutto sommato sono contento che sia accaduto ora. La cosa era molto nell'aria da parecchio tempo ed è probabile che velocemente vengano coinvolti anche altri paesi europei.
Per quanto GPT4 sia incredibile, e abbia delle capacità di problem solving impressionanti se pensiamo che di fatto è semplicemente una matrice piena di numeri, al momento non ha ancora così pervaso l'economia e la società moderna.

Otro día casi ha terminado y como otros días de mi viaje, he recorrido mucho por pie. Pues decidí renunciar a mi trabajo hace un mes, vendí mi vehículo y dejé la Universidad actualmente tengo unos 9000$ para migrar, se que no es mucho pero es algo, estoy entre USA, Canadá, España o Reino Unido.
como destino final me gusta más USA, ya que tiene de todos los tipos de clima, vistas, diversidad cultural y gastronomía.
Tengo un amigo en New York quien me recibiría mientras me establezco, por otro lado esta el tema de la espera a la cita consular de la embajada para la visa el cual es un tiempo de espera bastante alto y no es seguro que te la den. En España vive mi hermana y mejor amigo por lo que tengo donde llegar y establecerme y estaba pensando usar Madrid de trampolín y pedir cita consultar en la embajada de usa allí, ya que el tiempo de espera es mínimo debido a que los europeos no necesitan visa para ir a usa, y por otro lado Canada y Reino Unido, en ninguno de esos países conozco a nadie por lo que iría solo con lo que tengo a buscar trabajo desde el primer día, hablo inglés por lo que el idioma no sería una barrera, personas que migraron o están pensando hacerlo, algún consejo ? Donde debería ir ? Qué harían ustedes ?

hello! so all my college results are in and i thought i would share for the anxious ppl! here r my stats and demographics
i finished all my supplementals the night before so if u try harder ur results will probably be better 😭
I am a mixed ( african american and white) female from Texas hoping to major in general psychology :D
UW GPA: 3.83 abt after this year and my Weighted GPA is a 97.6 on a numeric skill very confusing but I think it’s abt 4.2 maybe ? i had an extreme upward trends in grades tho and am the top 10% of my class ,i had blood cancer ( t cell lymphoma) during this time and the pandamenic and it was pretty serious so ofc grades slipped but i had a very extreme upward trend bc of distanced learning
Coursework: 11 APS so far (APHUG (4) and AP World (4) APES (4) AP Lang (4) and APUSH (4) im taking 5 APS this year AP Stats , AP Lit, AP Psych, AP Gov, and AP Economics, and AP Physics 1 self study so 11 in total by the end of hs :) and I have taken 2 dual enrollment courses in French and have taken at least 6 other honors Also my school tremendously limited us and took away the IB program and only allowed us to take two APS in freshmen and sophomore year and then only en stated two other higher level classes that i did not take 😢 bc of scheduling test scores: 1540 SAT(800 reading and grammar and 740 math)
Awards: 6 State regional and area level awards in Tech Theatre
National Qualifier at Texas Thespian Theatre Festival for Theatre Marketing
Technology Student Association National and Regional Qualifier
District Outstanding Student of the Semester for Volunteer Work

Extracurriculars: could not do sports sophmore year so i was the manager due to immune issues
Technology Student Association President and Chapter State Representative and I was able to go nationals and qualify for semifinals and top 24 and pursued graphic design passions through TSA and competed in challenges related to digital art
Psychology Club Founder and President and am organizing a walk to raise money for American Mental Health Fund through the org
Model UN President and Founder
Worked at a summer camp for (7th,8th,11th) 3 years and became head counselor and also held a mental health week and partnered with an actual psychologist to help the kids with different activities to build self confidence
Drama Club/Tech Theatre : Lead technician for two years and have been lead in many different areas also run the instagram and have been participating in theatre for 10+ years
Sorta Nonprofit ?? not sure what to call it : i also founded an org focusing on the mental health of lgbtq + ppl not rlly an nonprofit bc that’s corny lol but we did raise a lot of money for underprivileged minorities to attend therapy by selling stickers i graphically designed!! and i upload podcasts and articles abt areas around this subject and we also work with my psychology club to broaden volunteer opportunities and have about 30 people volunteering for us rn :)
3 Varsity Sports - 1 I have played through almost all of HS and will be women’s captain next year Diversify our Narrative Co President and Social Media Manager
Essays : struggled with mental health bc of cancer so i might talk abt that in my essays along with finding out i was lgbtq which led me to found a passion for underrepresented communities finding help probably strong idk it’s a gamble

hello! so all my college results are in and i thought i would share for the anxious ppl! scroll to bottom for just results
here r my stats and demographics
I am a mixed ( african american and white) female from Texas hoping to major in general psychology :D
UW GPA: 3.83 abt after this year and my Weighted GPA is a 97.6 on a numeric skill very confusing but I think it’s abt 4.2 maybe ? i had an extreme upward trends in grades tho and am the top 10% of my class ,i had blood cancer ( t cell lymphoma) during this time and the pandamenic and it was pretty serious so ofc grades slipped but i had a very extreme upward trend bc of distanced learning
